All is quiet................................

It has been very quiet at the house for a couple of days. The builder appears to be stuck at the drywall phase.

According to their application for Revisions to the plan, the status states "Deficiency" under the Zoning review. Hopefully the city has realized that the house that has been built does not match that was approved at OMB.

Might this happen?

This house on Flemming Crescent in Leaside was built illegally and they were required to tear it down. These builders have broken many laws. Is it a matter of time before 277 gets torn down?

The landscaping is complete at 277 Belsize Dr. Interesting as they backfill and framing stages have not been approved by the city. You don't often seen the landscaping being completed before drywall goes in.

More Weekend Work

Link Line was shut down during the week as they did not have the approvals to dig, so they came back on the weekend when they knew there would be no municipal staff working. The city really needs to get better at enforcing by laws.

A little weekend work

The guys from Link Line were really not happy when I asked if they had permission to dig and also to move their truck out of the park. Link Line should be pleased with this type of representation. Anyways, they assured me it was ok to park in the park and to dig. We shall see.

NOW THEY ARE APPLYING FOR THE REVISIONS

The builders at 277 have filed an application for revisions to the permit. We must complain to the city as the new application has totally different heights for the exterior walls which requires them to go back to Committee of Adjustments.

Please contact the inspectors below to question the application so it does not get rubber stamped.

Apparently, the water has been flooding the house for a day and a half. The water was running down Belsize. Would hate to see what kind of damage has occurred inside the house. Rumor has it the plumbing was done incorrectly. Pipes might have burst. Buyer beware.

OMB IS A JOKE

This is the response discussing the change in the plans. OMB takes no responsibility.  They expect parties to respect and comply.  What a joke. The city objects to the plan, OMB approves it and then they say deal with the municipality.
 
 
Thank you for your email to the Ontario Municipal Board (OMB). When issuing decisions, the OMB expects that parties will respect and comply with the decision. If an individual or group feels a decision is not being adhered to, they can request a certified copy of the decision and file it with the courts where it can be enforced as a certified court order.
 
The building permit issued and construction that has occurred should be in conformity with the provisions of the municipality’s zoning by-law, whether or not those provisions were altered by a Board order. The OMB does not have the jurisdiction to investigate a development and or the issuance of a building permit.
 
If you feel the development is in violation of the provisions of the zoning by-law or policies of the official plan, you should raise your concerns with your municipality.

Refuses to respond to emails about the status of the house. The OMB approves terrible homes for our neighborhoods, but never follow up and hold the builders accountable. The OMB has become a joke and a waste of tax payers dollars.

Conditions of Approval

Thanks everyone for your interest and support. Here is the ruling from the OMB.

Please look at Page 8 for conditions of Approval.

1. Plan should look substantially the same?
2. No Above Grade Deck
3. All Drainage should be pointed away from the house
4. Window on east wall must be build of glass blocks
5. Urban forestry must approve the plan before demolition

I wonder if any of these conditions have been followed. Next post I will post pictures of what the house should look like.

Tree Protection Zone??

Another great picture from a Belsize resident. (keep them coming!) Here is the attempt from the builder to protect the trees in the park. They are lacking proper signage and they forgot to nail the barrier together. The large pieces of plywood could have fallen on children or dogs.

Does anyone have a photo of the Lumber being delivered by a grocery truck?
 
 
Another photo received from another Belsize resident. This builder started demolition and they were promptly shut down by the Ministry of Labor for a variety of reasons. Was this the first house they had demolished? The builder created a major safety issue given their inexperience and the house was at risk of falling down. They had to come in and build support to ensure the house did not fall down. Have you ever seen anything like this before? Buyers beware!

Do they have permits?

Thank you to our first visitor who sent this photo showing the demolition permit for the house. Does anyone know if they have the proper permits? They certainly are not posting their permits as required by the city by laws. Given they have broken every city by law, I would not be surprised if they did not have the proper permits. Buyers Beware!

This is a Blog for all residents on Belsize Drive that are disgusted with the owner and builders of 277 Belsize Drive. They have repeatedly broken the law and don't seem to care. Also the City seems to be at a loss of what to do, so let's see if as a community we can pressure the builders and owners to start following the rules.

This is an opportunity to share your stories, because I know we all have them, and to warn any potential buyers of who they are buying the house from!
